Tobacco Dealer License

Tobacco dealer licensing and electronic cigarette retailer registration for Chicago and Illinois — including BACP filings, background check coordination, and distance restriction compliance under Municipal Code Chapter 4-64.

Tobacco Licensing in Chicago: Requirements & Process

Any business selling tobacco products or electronic cigarettes in the City of Chicago is required to hold a City of Chicago Tobacco Dealer license issued by the Department of Business Affairs and Consumer Protection (BACP). This requirement applies to all retail operations selling cigarettes, cigars, pipe tobacco, smokeless tobacco, e-cigarettes, vaping devices, or any other tobacco or vapor product — regardless of whether tobacco is the primary or secondary product category.

Chicago's tobacco licensing requirements are governed by Municipal Code Chapter 4-64. The law requires background check and debt clearance for all owners with 25% or more interest in the business, location-based distance restrictions, and annual renewal. MLG manages the full tobacco license application process for new businesses, handles renewals, and advises on the distance restriction requirements that apply to your specific location.

Distance Restrictions for Tobacco Dealers

Chicago Municipal Code Chapter 4-64 prohibits the issuance of a new tobacco dealer license within 500 feet of a public, private, or charter school — measured in a straight line from the nearest boundary of the school property to the nearest wall of the business premises. MLG conducts a distance restriction review for every new tobacco license client before any application is filed or lease is committed to.

Additionally, certain community areas and aldermanic wards have adopted additional restrictions on tobacco retail density. MLG reviews ward-level restrictions and advises on their impact on your proposed location before any application is started.

Electronic Cigarette Retailer Registration

In addition to the standard tobacco dealer license, Chicago requires a separate Electronic Cigarette Retailer (ECR) registration for any business selling electronic cigarettes, vaping products, or e-liquids. The ECR registration is administered by BACP alongside the tobacco dealer license. MLG prepares and files both the tobacco dealer license application and the ECR registration as a combined package for retailers selling both tobacco and vapor products.

Illinois State Tobacco License

In addition to the Chicago municipal tobacco dealer license, all tobacco retailers in Illinois are required to hold a state-level tobacco retailer license from the Illinois Department of Revenue (IDOR). The state license requires a separate application and renewal process. MLG advises on state-level tobacco licensing requirements and assists with IDOR tobacco retailer registration as part of a comprehensive tobacco licensing package.

Annual Renewal Requirements

Chicago tobacco dealer licenses renew annually. BACP sends renewal notices approximately 60 days before the expiration date. Operating with a lapsed tobacco license can result in fines and forced cessation of tobacco sales. MLG manages the renewal calendar for all tobacco license clients and files renewal applications before deadlines — not after receiving a notice.

Common Questions

Tobacco Licensing — Frequently Asked Questions

Yes. Any business selling tobacco products in Chicago — including cigarettes, cigars, pipe tobacco, smokeless tobacco, or any tobacco product — must hold a City of Chicago Tobacco Dealer license from BACP. This is a separate license from your general business license, retail food establishment license, or packaged goods license. If you also sell electronic cigarettes or vaping products, a separate Electronic Cigarette Retailer (ECR) registration is required in addition to the tobacco dealer license.

Chicago Municipal Code Chapter 4-64 prohibits issuing a new tobacco dealer license to any business located within 500 feet of a public, private, or charter school. The distance is measured in a straight line from the nearest boundary of the school property to the nearest wall of the business premises. This restriction is reviewed by BACP during the application process. MLG conducts this distance review before the application is filed — and critically, before you sign a lease — to avoid investing in a location that cannot receive a tobacco license.

Obtaining a Chicago tobacco dealer license begins with the BACP Business Information Sheet (BIS), which captures your legal entity information, ownership, and business location. All owners, officers, and managers with 25% or greater interest must complete a background check and debt verification with the City of Chicago. The application also requires proof of legal entity formation and your IDOR Account ID. MLG prepares the complete application package, coordinates background checks, and files with BACP on your behalf.

Yes. In addition to the Chicago municipal tobacco dealer license, all tobacco retailers in Illinois must hold a state-level Tobacco Retailer's License issued by the Illinois Department of Revenue (IDOR). The state license is separate from the Chicago municipal license and has its own application, fee, and renewal schedule. For businesses outside Chicago city limits, a suburban municipal tobacco license may be required in place of (or in addition to) the state license, depending on your municipality. MLG advises on both municipal and state-level tobacco licensing requirements.

Operating a tobacco retail business without a current, valid tobacco dealer license exposes the business to fines, violation notices, and potential forced cessation of tobacco sales. Chicago tobacco dealer licenses renew annually. BACP sends renewal notices but relying solely on those notices is risky — mail issues and administrative delays can result in missed deadlines. MLG calendars all client renewal dates independently and initiates renewal filing 60 days before expiration to eliminate lapse risk entirely.
